FAQ's - From a Criminal Attorney that cares
  • Why is it important that I have a good lawyer?
    • I can't begin to tell you how many times I have seen someone regret hiring an attorney because they were the cheapest. 
      • In one case, a client was coaxed by an attorney to agreeing to a plea bargain on two seperate misdemeanor DWI charges.  Both cases were very borderline, not involving a breath test or accident.   These cases were pled on the first setting without the attorney having a chance to even look at the scene video.  The client later picked up another DWI, which involved a breath test failure, an accident, and was found in possession of a controlled substance.  This DWI was a felony and the client faced 2-10 years on a very difficult case to beat.  He wished he had hired an attorney that would have fought the prior two misdemeanor DWI charges.
      • In another case, I had a client come to my office to handle a "non-disclosure" or sealing of her record.  She had recieved a deferred adjudication on a shoplifting theft charge years ago.  She hired an attorney because he was the cheap one available and she was in high school at the time.  From listening to the facts of the case, there were many defenses that would have been worth pursuing at trial.  However, she listened to her attorney and her case was pled out  on the first setting as well. Theft is one of the many crimes of moral turpitude and many employers will not hire you if you have something of that nature on your record.  She was never informed of that or the option of going to trial.
      • In one last case, a potential client had called me concerning a driving while license suspended charge.  He was not aware that his plea bargain to a possession of marijuana charge resulted in his license being suspended and was never informed so by his attorney.   
    • There is nothing wrong with hiring an attorney based upon price.  However, I would recommend that you do your research before you fall into a "bargain attorney's" trap.  Ask many questions such as:
      • What were the results of the last 10 cases you have handled?  What you want to look out for are a large percentage of cases being pled and pled on the first few settings.  Ask to see the JIMS printouts of these cases to verify the results
      • Do you work closely with other attorneys?  And what qualifications do they have? 
      • Who do you use as a private investigator?  This is important because many cases require the use of one
  • What lawyers should I avoid?
  • What sets you apart from other attorneys?
  • Someone I know just got arrested.  What should I do now?
  • What if I cannot afford to post the entire bond?
  • What if I cannot afford both the bond and hiring an attorney?
  • How do I find a bonding company?
  • Can you guarantee a specific result?
  • How much do you charge?
  • What if I cannot pay the entire fee all at once?
  • Should I take a breath-test or perform the Standard Field Sobriety Tests?
